These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity ('you'), and Babul Raj Singh ('we', 'us', or 'our'), concerning your access to and use of the Vishram mobile application (the 'App') as well as any other media form, media channel, or website related, linked, or otherwise connected thereto (collectively, the 'Services').
You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Terms of Use. If you do not agree with all of these Terms of Use, then you are expressly prohibited from using the Services and you must discontinue use immediately.
We may make changes to these Terms of Use at any time. The updated version will be indicated by an updated 'Last updated' date, and the updated version will be effective as soon as it is accessible. We encourage you to review these Terms of Use frequently so you are aware of which version applies. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms of Use by your continued use of the Services after the date such revised Terms of Use are posted.
The Services let you browse and search for movies and shows using data from The Movie Database (TMDB), save titles to a personal library across four states (saved, watching, done, liked), follow directors and actors, and earn badges as you use the App.
This product uses the TMDB API but is not endorsed or certified by TMDB. Movie and show data, images, and posters shown in the App are provided by TMDB and remain subject to TMDB's own terms of use.
We own or license all intellectual property rights in the Services, including the source code, design, App name, logo, and all badge artwork, other than the third-party movie and show data described in section 1.
The App's source code is published on GitHub. If a license file accompanies that repository, your use of the source code itself is governed by that license, separately from these Terms, which govern your use of the compiled App as distributed through the Google Play Store. Nothing in that source-code license grants you rights to use the Vishram name, logo, or badge artwork.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a device you own or control, solely for your personal, non-commercial use.
By using the Services, you represent and warrant that:
You must be at least 13 years old to use the Services. If we learn we have collected personal information from someone under this age, we will take reasonable steps to delete that information.
You may be required to register to use parts of the Services, either by creating an account directly or by signing in with a third-party account such as Google, Facebook, or GitHub. You agree to keep your password confidential and are responsible for all use of your account. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.
We may offer certain features, content, or removal of advertisements for purchase through the Google Play Store's in-app billing system. All purchases are processed by Google Play, and Google Play's own terms and refund policies apply to the payment itself. We do not currently store your payment card details — see our Privacy Policy for how payment-related data is handled.
You may not access or use the Services for any purpose other than that for which we make them available. As a user of the Services, you agree not to:
We show advertisements in the App, served by Google (Google AdMob), and offer sign-in through third-party providers (Google, Facebook, GitHub). Your use of these features is also subject to that provider's own terms and policies. We are not responsible for the content, accuracy, or opinions expressed on any third-party service, and we do not investigate, monitor, or check such services for accuracy or completeness.
Movie and show data displayed in the App is provided by TMDB and is subject to TMDB's terms of use and API terms.
We reserve the right, but not the obligation, to monitor the Services for violations of these Terms of Use, take appropriate legal action against anyone who violates these Terms, refuse, restrict, or disable your access to the Services, and otherwise manage the Services in a manner designed to protect our rights and property and to facilitate the proper functioning of the Services.
These Terms of Use remain in full force and effect while you use the Services. We reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the Services to any person for any reason, including breach of any representation, warranty, or covenant contained in these Terms of Use, or of any applicable law or regulation.
If we terminate or suspend your account, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party.
We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason at our sole discretion without notice. We also reserve the right to modify or discontinue all or part of the Services without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Services.
We cannot guarantee the Services will be available at all times. We may experience hardware, software, or other problems, or need to perform maintenance related to the Services, resulting in interruptions, delays, or errors.
These Terms of Use and your use of the Services are governed by and construed in accordance with the laws of India applicable to agreements made and to be entirely performed within India, without regard to its conflict of law principles.
Any legal action of whatever nature brought by either you or us shall be commenced in the courts located in Samastipur, Bihar, India, and you consent to, and waive all defences of lack of personal jurisdiction and forum non conveniens with respect to, venue and jurisdiction in such courts.
There may be information on the Services that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, and availability. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Services at any time, without prior notice.
The Services are provided on an 'as-is' and 'as-available' basis. You agree that your use of the Services will be at your sole risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the Services and your use thereof, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no warranties or representations about the accuracy or completeness of the Services' content or the content of any websites or apps linked to the Services, and we will assume no liability for any:

You agree to defend, indemnify, and hold us harmless from and against any loss, damage, liability, claim, or demand made by any third party due to or arising out of your use of the Services, your breach of these Terms of Use, or your violation of the rights of a third party, including but not limited to intellectual property rights.
We will maintain certain data that you transmit to the Services for the purpose of managing the performance of the Services, as well as data relating to your use of the Services, as described in our Privacy Policy. Although we perform regular backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Services. You agree that we shall have no liability to you for any loss or corruption of any such data.
These Terms of Use and any policies or operating rules posted by us on the Services constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms of Use shall not operate as a waiver of such right or provision.
